1. Introductory provisions
1.1. These Terms and Conditions (the “T&C”) govern the conditions of use of the urban discovery adventure game (the “Service”) related to the Pesti Vigadó building, sold through the webshop operated on the vigadomystery.cloud website (the “Website”) by Matyas Anna, sole proprietor (the “Service Provider”), concluded between the Service Provider and the customer (the “User” or “Player”).
1.2. By using the Website or placing any order, the User accepts these T&C as binding. A prerequisite for ordering the Service is that the User expressly accepts the T&C by ticking the checkbox on the checkout page.
1.3. The T&C have been drawn up in Hungarian; the language of the contract is Hungarian. The English translation is for information purposes only; in case of any dispute over interpretation, the Hungarian text prevails.
1.4. The Service Provider reserves the right to unilaterally amend these T&C. Amendments take effect upon publication on the Website and apply to orders placed after publication. Orders already placed are always governed by the T&C in force at the time of the order.
1.5. The contract is not considered to be concluded in writing, and is not archived in written form. Order data are stored electronically and retained for the period required by accounting and tax rules.
1.6. Matters not regulated by these T&C are governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on Electronic Commerce Services, Government Decree 45/2014 (II. 26.) on the detailed rules of consumer contracts, and Act CLV of 1997 on Consumer Protection.

4. Description of the Service
4.1. The Service is an urban discovery adventure game played through a smartphone web browser, set at the Pesti Vigadó building and its immediate surroundings. Access is granted via a unique game code (the “Code”) purchased from the Service Provider. The game is self-guided and completed at the Player’s own pace, without a game master.
4.2. Completing the game requires the Player to enter the Pesti Vigadó building. Entry to Pesti Vigadó requires the purchase of a so-called “Házjegy” (house ticket), which the Player buys on site at the Pesti Vigadó ticket office. Upon presentation of the Vigadomystery code the Player is entitled to a 50% discount on the Házjegy, the current discounted price of which is HUF 1,500. The price of the Házjegy and the availability of the discount are determined by Pesti Vigadó at its sole discretion; the Service Provider accepts no liability for any change thereto. The price of the Házjegy is not included in the price of the game and is paid by the Player directly to Pesti Vigadó.
4.3. It is the Player’s responsibility to ensure that Pesti Vigadó is open to visitors at the time the game is played. Current opening hours are available on the official Pesti Vigadó website (vigado.hu).
4.4. Technical requirements: a smartphone with an internet connection and a modern web browser. Free Wi-Fi is available inside Pesti Vigadó. No separate app installation is required.
4.5. The expected duration of the game is approximately 60 minutes, but may be shorter or longer depending on individual pace. The Player may interrupt and later resume the game at any time within the Code’s validity period.
4.6. The Code is valid for 1 (one) year from the date of purchase and can be activated once. One Code grants access for one Player or one group of Players. The Code may be transferred to a third party.
4.7. Minors may participate only under the supervision of an adult with full legal capacity. The supervising adult is responsible for the minor’s safety and for compliance with these T&C.
4.8. The game is a work of fiction. Characters, events and statements in the game serve entertainment purposes only and do not constitute factual statements about Pesti Vigadó, its staff or any historical person.
5. Purchase procedure
5.1. The User may select from the products offered on the Website (game code, gift code). Product descriptions, prices and related information are shown on the product page.
5.2. The User adds the selected product to the cart via the “Add to cart” button. The order is finalised on the “Checkout” page after entering billing and delivery data, selecting a payment method, and accepting these T&C and the Privacy Notice, by clicking the order-placement button (which creates a payment obligation).
5.3. The Service Provider confirms receipt of the order without delay by e-mail to the address provided by the User. If this confirmation does not arrive within 48 hours of submitting the order, the User is released from the offer.
5.4. The contract is concluded upon successful completion of payment or, in the case of bank transfer, upon the price being credited to the Service Provider’s bank account.
5.5. Correction of input errors: before order finalisation, the User may modify data at any time in the cart and on the checkout page. After order submission, errors should be reported to hello@vigadomystery.cloud; the Service Provider will make reasonable efforts to correct errors prior to starting performance.
6. Prices and payment methods
6.1. Prices shown on the Website are in Hungarian forints (HUF) and – given the Service Provider’s VAT-exempt (AAM) status – do not include Hungarian VAT. Prices shown are gross consumer prices.
6.2. The Service Provider offers the following payment methods, as actually displayed on the checkout page:
- Bank transfer – to the bank account communicated in the order confirmation e-mail, using the order identifier as the payment reference. The contract is concluded upon credit of the price.
- Online card payment via Stripe – payment is processed by Stripe Payments Europe, Ltd. (seat: 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland). The Service Provider does not have access to card data, which is handled by Stripe in accordance with applicable data protection rules.
6.3. Invoices are issued electronically in accordance with Hungarian tax rules and delivered to the User by e-mail. By placing the order, the User expressly consents to the issue of electronic invoices.
6.4. In the event of a payment error, failed transaction or non-receipt of the price within 14 (fourteen) calendar days, the Service Provider is entitled to cancel the order.
7. Performance of the Service
7.1. The Service Provider delivers the Code to the User’s e-mail address after receipt of payment – normally within 24 hours, but no later than within 5 working days.
7.2. If the Code is not received within the period set out in section 7.1, the User shall notify the Service Provider without delay, but at the latest within 5 (five) calendar days of the order date, at hello@vigadomystery.cloud. The Service Provider will investigate the case without delay and resend the Code.
7.3. The Service is considered performed upon delivery of the Code by e-mail.
8. Gifting
8.1. A purchased Code may be gifted to a third party. Where the gifting function is used, the Service Provider delivers the Code to the recipient’s e-mail address specified by the User, or – at the User’s option – makes a printable gift voucher available.
8.2. A gifted Code is governed by all provisions of these T&C in the same way – in particular by the validity period and single-use rule set out in section 4.6.
9. Right of withdrawal
9.1. A User who qualifies as a consumer under the Civil Code may, pursuant to Government Decree 45/2014 (II. 26.), withdraw from the contract without giving any reason within 14 (fourteen) calendar days of contract conclusion.
9.2. Pursuant to Section 29(1)(a) of Government Decree 45/2014 (II. 26.), the User may not exercise the right of withdrawal in respect of a service contract whose performance has been commenced by the Service Provider with the User’s express prior consent, where the User has acknowledged that the right to terminate will be lost after full performance. For the purposes of these T&C, commencement of performance of the Service means activation of the Code by the Player, i.e. the first start of the game with the Code.
9.3. A template withdrawal statement:

9.4. The withdrawal statement may be sent to hello@vigadomystery.cloud. If sent within the deadline, the right of withdrawal is deemed to be exercised in time.
9.5. Upon receipt of the withdrawal statement, the Service Provider refunds the User’s payment without delay, but no later than within 14 days. Refunds are made using the same payment method as used in the original transaction, unless the User expressly consents to a different method; such different method may not entail any additional cost for the User.
9.6. If the User has already activated the Code, the right of withdrawal is lost in accordance with section 9.2, and the Service Provider is not obliged to refund the price.
10. Warranty and complaint handling
10.1. Statutory warranty (kellékszavatosság). In the event of defective performance by the Service Provider, the User may exercise statutory warranty rights under the Civil Code: at the User’s choice, repair or replacement, unless the chosen remedy is impossible or disproportionately costly for the Service Provider compared with another remedy. Where repair or replacement is not sought or is unavailable, the User may request a proportionate price reduction or – as a last resort – rescind the contract. Rescission for minor defects is not permitted.
10.2. The User shall communicate the defect to the Service Provider without delay after discovery. A defect communicated within two months of discovery is considered communicated without delay. Statutory warranty rights may be exercised within 2 (two) years of performance.
10.3. The Service Provider’s statutory warranty does not extend to defects caused by the Player’s device (smartphone, network, battery), inadequate internet connection, operational issues of third-party services (e.g. Pesti Vigadó’s opening hours, Wi-Fi availability), or events of force majeure beyond the Service Provider’s control.
10.4. Complaints. Complaints about the Service or the Service Provider’s conduct, activity or omission may be sent to hello@vigadomystery.cloud or by post to the seat set out in section 2. The Service Provider investigates the complaint without delay and provides a substantive written response no later than within 30 days of receipt.
10.5. The Service Provider keeps a record of complaints and responses thereto for 3 years.
11. Consumer protection and remedies
11.1. Consumer protection authority. A User may file a consumer-protection complaint with the competent government office according to the User’s place of residence (the Transport, Technical Licensing and Consumer Protection Department of the government office). 11.2. Conciliation body. The conciliation body (békéltető testület) competent according to the Service Provider’s seat is the Budapest Conciliation Board (address: 1016 Budapest, Krisztina krt. 99. III/310; postal: 1253 Budapest, Pf. 10; e-mail: bekelteto.testulet@bkik.hu; phone: +36 1 488 2131). The consumer may also turn to the conciliation body competent for the consumer’s place of residence or stay.
11.3. Online Dispute Resolution. The European Commission operates an Online Dispute Resolution (ODR) platform for disputes arising from online purchases, available at: ec.europa.eu/consumers/odr.
11.4. Court proceedings. The User may also enforce claims before the courts in accordance with the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.
12. Intellectual property
12.1. The Website, the story, tasks, graphics and text of the game and all content created by the Service Provider are the exclusive intellectual property of the Service Provider and are protected under Act LXXVI of 1999 on Copyright and applicable intellectual property law.
12.2. Any unauthorised copying, reproduction, translation, adaptation, public communication, distribution or other exploitation of the game or any of its elements is prohibited, including both commercial and non-commercial use.
12.3. The Service Provider grants the User a limited, non-exclusive, non-transferable, personal right of use confined to the single, non-commercial completion of the purchased game.
13. Limitation of liability
13.1. The Service Provider does not warrant continuous, uninterrupted and error-free operation of the Website and accepts no liability for damages arising from Website malfunction, from the User’s device, from events at or around the Pesti Vigadó building, from third-party conduct, or from events of force majeure.
13.2. The Service Provider’s liability is limited to the amount of the fee paid by the User, save for liability for wilful damage and for breach causing damage to human life, bodily integrity or health.
13.3. The game is completed at the Player’s own risk. The Player shall observe traffic and public-space rules, pay attention to personal and others’ safety while walking, and respect the house rules of Pesti Vigadó.
14. Data protection
14.1. The Service Provider processes the User’s personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act CXII of 2011 on informational self-determination. Details of processing – legal bases, purposes, and data subjects’ rights – are set out in the separately published Privacy Notice.
15. Miscellaneous
15.1. These T&C, the order and the order-confirmation e-mail together form the content of the contract between the Service Provider and the User.
15.2. If any provision of these T&C becomes invalid or unenforceable, this does not affect the validity of the remaining provisions; the invalid provision is replaced by a valid provision that best reflects the parties’ contractual intent.
15.3. These T&C are governed by Hungarian law. The Hungarian courts have exclusive jurisdiction over disputes arising from the contract.
